1. Who We Are
This Privacy Policy explains how Saint Martin Sailing Club, a non-profit association operating the website sxmsailing.com under the name SXM Sailing (“SMSC,” “we,” “us,” or “our”), collects, uses, shares, and protects your personal information when you visit our website, join a training session, charter a boat, enter a race, volunteer, or otherwise interact with us.
SMSC is established in Saint-Martin, a French overseas collectivity and outermost region of the European Union. Because of that, this policy is built around the EU General Data Protection Regulation (GDPR), with added notices for visitors from other U.S. states and Canada in Section 10.

2. Information We Collect
Information you give us directly
- Enquiries & communications — your name, email, phone number, and the content of any message, when you contact us about training, charters, racing, membership, or volunteering.
- Training & charter registration — contact and billing details, emergency contact, sailing experience or certifications, and any medical condition, injury, or allergy relevant to your safety on the water.
- Racing and regatta entry — skipper and crew names, nationality, sailing association or World Sailing ID, boat details, and emergency contact information required by event organizers (for example, the World Diam 24 Tour or our club racing calendar).
- Membership & volunteering — contact details and areas of interest, such as race committee, event logistics, boat maintenance, or coaching support.
- Payment information — billing details and card information, handled by our payment processor; we don't store full card numbers ourselves.
Information collected automatically
When you browse sxmsailing.com, our hosting provider and any analytics tools we use may collect your IP address, browser and device type, pages viewed, and referring site, typically via cookies (see Section 6).
Photos & video
We regularly photograph and film training, racing, and charter activities for our website, social media, and promotional materials. If you'd rather not appear, let us know and we'll do our best to accommodate that.

You can withdraw consent at any time by contacting us; this won't affect anything done before you withdrew it.
4. Health Information (Special Category Data)
Because SMSC runs high-performance sailing activities, we may ask about swimming ability, medical conditions, injuries, or allergies before a training session, charter, or race. Under GDPR this counts as “special category” data. We only collect it with your explicit consent — or, in an on-the-water emergency, to protect someone's vital interests — and access is limited to those who need it to keep you safe.
5. How We Share Your Information
We don't sell your personal information. We share it only with:
- Service providers supporting our operations, such as payment processing, hosting, and email, under agreements limiting them to our instructions.
- Race organizers and sailing authorities, where entry rules for an event require it.
- Insurers, to arrange or process cover for an activity.
- Public authorities, where the law requires it, or to protect the safety of you or others.
- A successor organization, should SMSC ever merge with or transfer its activities to another body.
6. Cookies
Our site may use cookies and similar technologies to remember your preferences, keep the site working properly, and understand how it's used. You can block or delete cookies through your browser settings; some site features may work less well if you do.
7. International Data Transfers
Some of our service providers are based outside the European Economic Area, including in the United States and Canada. Where personal information leaves the EEA, we rely on recognized safeguards, such as the European Commission's Standard Contractual Clauses or an applicable adequacy decision.
8. How Long We Keep Information
We keep personal information for as long as needed for the purpose it was collected: generally for the length of your relationship with SMSC as a customer, member, or volunteer, plus a further period to meet our accounting, tax, and insurance obligations. Safety information collected for a specific activity is kept only as long as that activity and any related liability period require, then deleted or anonymized.

We use reasonable technical and organizational measures, including restricted access to sensitive information and secure payment handling, to protect your personal data. No system is completely secure, and we can't guarantee absolute protection.
10. Your Rights
Under GDPR, you can:

- Correct inaccurate information
- Request deletion, subject to legal exceptions
- Restrict or object to certain processing
- Receive your data in a portable format
- Withdraw consent at any time, without affecting past processing

11. Children's Privacy
Junior sailors sometimes take part in our programs. Where a participant is under 18, we collect their information from — and require consent from — a parent or legal guardian, rather than from the child directly.
12. Third-Party Links & Social Media
Our site may link to other websites, including our social media pages. We aren't responsible for their privacy practices and encourage you to review their own policies.

We may update this policy from time to time. The “Last updated” date above reflects the most recent version, and we'll post any significant changes here.
